Terms of Service

Effective date: July 20, 2026

These Terms of Service ("Terms") govern your use of the Spice Capture mobile application and the website at spicecapture.com (together, the "Service"), provided by Spice Data ("we", "us"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

The Service is intended for contractors we have engaged for work at designated job sites. You must have received a Worker ID from us to use the App. You must be at least 18 years old.

2. Acceptable use

You agree not to:

  • Use the Service for any purpose other than documenting work at your assigned job sites;
  • Upload content that is unlawful, defamatory, obscene, or infringes any third party's rights;
  • Photograph people, private property, or restricted areas without appropriate authorization;
  • Attempt to access another contractor's Worker ID or data;
  • Reverse engineer, disassemble, or otherwise attempt to derive source code from the App;
  • Use automated means to submit content.

3. Content and license

You represent that you have the necessary rights and permissions to submit any photos or videos you upload. You grant Spice Data a worldwide, non-exclusive, royalty-free license to store, process, and use the content you upload for the purpose of operating the Service and delivering the work you were engaged to perform.

4. Privacy

Our handling of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

5. Service changes and availability

We may modify, suspend, or discontinue the Service at any time without notice. We are not liable for any modification, suspension, or discontinuation.

6. Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SPICE DATA WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY IN ANY MATTER ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

8. Termination

We may suspend or terminate your access to the Service at any time, for any reason, without notice. You may stop using the Service at any time by signing out of the App.

9. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Any dispute arising under these Terms will be resolved exclusively in the state or federal courts located in San Francisco County, California.

10. Changes to these Terms

We may update these Terms. When we do we will change the effective date above. Continued use of the Service after the update constitutes acceptance.
